There is no right to return the car, so don't even go there.. This is why all new cars come with a factory warranty. The dealer will repair it at no charge.
check the brake fluid in the master cylinder and make sure the emergency brake isn't on, even just a little bit could cause light to come on
You have a warranty for a reason. Things sometimes go wrong with new mechanical stuff. You take it back to the dealer and get it fixed. Probably just a loose connection.
Take it to the dealership unless it is same light for handbreak which you maybe did not release all the way .

bought a new spark, only has 50 miles on it and the brake lights went on.
